Adoption Contract

1. The Adopter shall provide the Animal with humane care and maintain it in accordance with all current and future state, county and municipal laws and ordinances where the Adopter resides; including licensing where applicable.

2. The Adopter shall provide the Animal with necessary veterinary care upon sickness, disease or injury. In addition, the Adopter shall take it to the veterinarian once a year for an annual health examination and routine vaccinations as recommended by their Veterinarian. SMAWL makes no representations or warranties as to the health of this Animal. If a previously undiagnosed health issue is discovered and documented by a licensed veterinarian within 14 days of adoption, the Animal may be returned to SMAWL for a full refund of the Adoption fee. SMAWL does not reimburse for medical bills.

3. If, for any reason, the Animal cannot be kept by the Adopter, the Adopter shall return it to SMAWL. The Animal shall not be given away, sold or exchanged without the prior written permission of SMAWL. If an animal must be returned to SMAWL, the Adopter shall allow SMAWL a sufficient amount of time considering animal, breed and foster space to find a suitable foster home.

4. The Animal shall reside at the Adopter’s address. All dogs are to be housed primarily inside the home of the adopter. If the Animal is a dog, the Adopter shall provide it with a fully fenced yard or other humane means of exercise. The Animal shall not be chained or allowed to run at large.

5. The Adoption fee is non-refundable after a three (3) day grace period.

6. Cats or kittens shall not be declawed; dogs or puppies shall not have their ears cropped or tails docked unless it is deemed to be a medical necessity.

7. Adopter consents to reclamation of the Animal by SMAWL at any time for failure to comply with the terms the terms of this Contract or for any misrepresentation of fact the Adopter made to SMAWL representatives or on SMAWL’s Adoption Application, which shall be incorporated herein by reference.

8. The adopter agrees to continue flea preventive after the adoption. If the Animal is a dog, the Adopter agrees to continue heartworm prevention after the adoption.

9. The Adopter, from the date of this Contract, agrees to release and indemnify SMAWL from any and all claims, known and unknown, now or hereafter arising in connection with the Animal.

10. The Adopter agrees to pay SMAWL any and all expenses, including court costs and reasonable attorney’s fees, in enforcing all terms and provisions of this Contract. The sum of $1,000 shall be due and owing to SMAWL if the Adopter is found to have declawed a cat, cropped the ears of a dog or docked the tail of a dog, unless it was deemed to be a medical necessity. The final determination of medical necessity will be made by a veterinarian of SMAWL’s choosing. This sum is not a penalty and is in addition to any other fees or donations noted herein. This sum has been agreed to by the Adopter and SMAWL as necessary to compensate SMAWL for the unnecessary and inhumane mutilation of the Animal.

11. This Animal has been accepted into our Foster-to-Adopt Program so it can enjoy its forever home while waiting to be old enough or well enough to complete the medical care provided by SMAWL. *

11. (continued, N/A if "No" is selected above) During the Foster to Adopt period, SMAWL still maintains ownership of the Animal and the Animal is considered a foster animal. All medical visits must be facilitated through SMAWL at a pre-approved veterinarian. All expenses incurred during this period are the responsibility of the Adopter, except for those pre-approved by a SMAWL Board Member. The Foster-to-Adopt period will be considered complete on the day of the last required medical appointment as determined by SMAWL, this date is considered the date of Adoption. At this point, ownership of the Animal transfers to the Adopter. All medical appointments must be completed within 30 days of this contract, or as otherwise documented by a SMAWL representative. If arrangements have not been made by the Adopter to complete medical appointments by this date the Animal must be returned to SMAWL.
