LOVE-A-BULL, INC.

Foster Caregiver Agreement

By agreeing to foster in partnership with Love-A-Bull I agree to the following:

Care and Nurturing: I agree to be fully responsible for the safety and well being of the foster dog. I will provide a safe, loving, humane environment with adequate food, water and shelter at all times. I will not leave the foster dog unattended in the back yard whether I am home or not, nor will I tie the dog to any anchors and leave unattended. I agree to safely secure my foster dog in the crate or other secure area, untethered by an anchor, inside my home and away from contact with other pets when I cannot directly supervise them. I will not crop the ears or crop tail of a fostered dog, nor will I make any medical decisions for the dog without Love-A-Bull’s written (email or text) approval. I will not punish physically or harshly yell at the foster dog. I will ensure the foster dog wears a collar with identification at all times. I will promptly notify Love-A-Bull immediately if the foster dog becomes lost. I agree to notify the appropriate Love-A-Bull representative if I plan to be out of town so that arrangements can be made to care for the foster dog in my absence.

Pet’s Safety: During my time as a foster parent, I will not allow my foster dog to interact with any animal other than those owned by me and that are disclosed on the foster application. I further agree that I will NOT allow my foster animal off-leash even in designated leash free-zones such as dog parks and hiking trails.

Pet's Temperament and Behavior: I understand that Love-A-Bull cannot guarantee the health or disposition of any foster dog and does not always have past records for these animals. I understand that there are some risks associated with taking in foster dogs that are out of Love-A-Bull’s control.

Health and Wellness: I agree to keep all my pets current on all vaccinations, including without limitation, bordetella, parvo, distemper, and rabies. I will give the monthly heartworm and flea/tick preventatives provided by Love-A-Bull to my foster dog. I agree to separate any animal showing symptoms of illness from the other animals in the home as soon as symptoms are observed, and to seek veterinary care and notify Love-A-Bull immediately.

State and Local Laws: I agree to abide by the laws of the State of Texas, including those of local municipalities and counties regarding animals, this includes, but is not limited to, local leash laws. I will ensure the foster dog wears a collar with identification at all times. I will promptly notify Love-A-Bull immediately if the foster dog becomes lost.

Return of Animals: I agree that I am fostering this dog for Love-A-Bull and that I do not have any right of ownership over the foster dog. I understand that the State of Texas views pet animals as property, and under law all foster dogs within the Love-A-Bull program are the legal property of Love-A-Bull. If the foster dog is requested returned by Love-A-Bull, I agree to return the dog within 24 hours of the request. I agree to allow Authorized Love-A-Bull representatives designated access to my home and property to check on the foster dog at any time while I am in possession of the foster dog. I understand that if I wish to adopt the foster dog, I will be subject to Love-A-Bull’s standard adoption process.

Supplies: I agree to promptly return any foster supplies that Love-A-Bull has provided during my time as an approved foster home. I understand and agree that any flea/tick, heartworm preventative or food supplied by Love-A-Bull is to be used solely for the foster dog and not for any personal animals I may already have in my home.

No Transfer Allowed: I understand that I am not allowed to give, sell or adopt out a dog in my care to anyone else without the written consent of Love-A-Bull’s Board of Directors.

Love-A-Bull feels it is important for all caregivers to be current on their tetanus vaccination if they will be handling animals as a foster. If a foster has questions about the tetanus vaccination, he or she is encouraged to consult a physician, at their own expense, to decide whether or not to be vaccinated against tetanus. If I opt out of such treatment, I release Love-A-Bull from all responsibility that may occur as a result of not being vaccinated against tetanus, and I understand that whatever decision I make regarding vaccinations for my child/children is at my own risk.

Photo Release: I agree on behalf of myself, my heirs, assignees, guardians, and personal and legal representatives and executors to allow Love-A-Bull to use any photographs and images taken of my family members when included in photographs of the foster dog provided by the foster or taken at events without payment. I understand that Love-A-Bull reserves the right to use any and all photographs or to promote Love-A-Bull services or Love-A-Bull programs, or to publicize any event without payment or notification. I understand that all prints and negatives become the sole property of Love-A-Bull and may be used by Love-A-Bull without payment or notification.

In case of an accident or unusual occurrence I will immediately notify a Love-A-Bull Board member or representative.

I understand I must obtain approved written permission from Love-A-Bull for each proposed usage of the Love-A-Bull name/logo or Pit Crew name/logo.

I understand Love-A-Bull materials and logos are the property of Love-A-Bull and I will not use them without express written consent of a Love-A-Bull Board Member.

I agree not to create any website, Facebook or other social media page, or any other public forum with the intent to slander or do malicious harm by referencing or referring to Love-A-Bull or its employees, volunteers, officers, directors, and/or board members whether past or present with disparaging content.

I agree to only contact other members of the Love-A-Bull organization, such as volunteers, fosters, adopters, officers, and/or directors for the purposes in which their contact information was shared with me and not to solicit, disparage the organization, or any other reason that reflects poorly on Love-A-Bull.

Accuracy of Information: By signing below, I acknowledge that the information provided to Love-A-Bull on my foster application is correct to the best of my knowledge. If at any time the information I have provided changes, I will provide the updated information to Love-A-Bull's Adopt-A-Bull Foster Care Program.

I understand that if I am approved for fostering, this declaration represents a legal contract between me as the foster home caregiver and Love-A-Bull. I understand that if I am approved to foster a dog, I must abide by this agreement and that this agreement applies to any and all dogs that I foster with Love-A-Bull. Any breach of this agreement will result in the termination of the foster agreement and may result in legal action.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Love-A-Bull Inc, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "LAB"), I hereby agree to release, indemnify, and discharge LAB, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that my participation in animal rescue, animal training events, and adoption activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I understand all incidents and accidents caused by adopted canines are solely my responsibility.

The risks include, among other things: losing control of the dog may result in chases or approaches of persons upon streets, sidewalks, or any public grounds in a menacing fashion or apparent attitude of attack, a dog irrespective of its training and usual past behavior and characteristics may act or react unpredictably at times based upon instinct or fright; dog may bite or scratch; dogs with aggressive behaviors should not be around children or vulnerable adults, dogs should be lead on a leash when outside the home; transmissible pathogen or disease.

2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

3. Indemnity, release and hold harmless agreement in favor of LAB. I hereby voluntarily release, forever discharge and agree to indemnify and hold harmless LAB from any and all claims, demands, or causes of action based upon or arising out of injuries, including death, to persons, or damages to or destruction of property, sustained or alleged to have been sustained in connection with, arising out of, or in any way related to my participation in this activity or my use of LAB’s equipment or facilities, including any such claims, demands or causes of action which are based or founded, in whole or in part, upon the alleged negligent acts or omissions of LAB.

4. Should LAB or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6. In the event that I file a lawsuit against LAB, I agree to do so solely in the state of Texas, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against LAB on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at LAB. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
